Regulation O generally requires banks to ensure that loans to insiders are made on the same terms and conditions as comparable loans made to non-insiders. While that may seem pretty straightforward, different restrictions can apply based not only on the type of insider but also based on the type of credit. For example, there are restrictions on the amount of credit that can be extended to an executive officer, unless the credit is being obtained for a specific purpose as outlined in the regulation, such as to finance their child’s education. Regardless of the amount or purpose of credit, there are additional requirements to consider when lending to executive officers that banks need to be aware of.
