Advertising & Electronic Media

Did you know that some regulations have exemptions for advertising via electronic media? In many cases, the regulations haven’t kept up with changing technology, so what the regulations consider “electronic media” probably is not what you think.

Electronic media. You'll hear as we go through some, but not all, of these regulations that there are exemptions for electronic media. What they mean by that is the scrolling billboard, the marquees that move, and things like that, that are electronically produced. The internet does not qualify. Email does not qualify. Think about those as being paper. I can study the newspaper. I can print it out. You mail me a letter, that kind of thing. I don't need the efficiency that these exemptions provide because I can sit and stare at my screen and print it out. And so those don't get the exemptions you'll see when discussing electronic media. Electronic media, and says there, do not address messages made through institutions, websites, or other online banking systems. That would include Twitter, Facebook, Instagram, and all the other social media types of things. Those do not get these exemptions that you'll see for electronic media.

David is on the faculty of the American Bankers Association National Compliance Schools and has served on the faculty of the Center for Financial Training for many years. He also is a frequent speaker at the ABA’s Regulatory Compliance Conference. He is also a trainer for hundreds of webinars, is a Certified Regulatory Compliance Manager (CRCM) and has been a BankersOnline Guru for many years. The American Bankers Association honored David with their Distinguished Service Award in 2016.

David and his wife Karen have three adult children, four grandchildren (none of whom live at home!) and two cats (of which Dave is allergic … the cats, not the children!). They recently moved to an acreage outside of Lincoln, Nebraska where he gets to play with his tractor. When possible David can be found fishing, making sawdust in his shop, or playing the guitar and piano. He also enjoys leading worship at his church.
