FDIC Advertising Final Rule Update

The FDIC recently issued a Final Rule to amend the signage requirements for digital deposit-taking channels (§328.5) as well as ATMs and like devices (§328.4). The mandatory compliance date is April 1, 2027.

The concept of an “official digital sign” is still intact from the December 2023 Rule; however, the very specific formatting requirements have been relaxed to some degree. There will be sign requirements for certain digital deposit-taking channels related to non-deposit products.  The Final Rule also specifies sign requirements for the “initial screen” on ATMs (and similar devices) that receive deposits, which depend on whether the ATM was put into service before or after the mandatory compliance date of April 1, 2027.
