Construction Holdbacks in Section K of the Closing Disclosure
The third page of the Closing Disclosure provides a summary of the borrower’s loan transaction in the aptly named “Summaries of Transactions” Table. Within this Table, Section K details the amounts due from the borrower at closing and includes things like the sale price of the property, the closing costs to be paid at closing, etc. While this Section is pretty straightforward, additional information often needs to be disclosed when it comes to a construction loan. For instance, if a portion of the loan proceeds will be placed in a reserve or other type of account to be disbursed at a later date, this “holdback” amount is also disclosed in Section K.
