FDIC Signs Compliance Delay

In case you missed it, the FDIC issued a Final Rule on November 25th to officially push the mandatory compliance date for §328.4 (Signs for automated teller machines and like devices) and §328.5 (Signs for digital deposit-taking channels) out from March 1, 2026 to January 1, 2027. As you may recall, the FDIC issued a Notice of Proposed Rulemaking back in August 2025 related to these sections which did also include a provision to move the mandatory compliance date out to January 1, 2027; however, this Final Rule helps alleviate concerns that institutions ...would need to make investments in preparation for a March 1, 2026, compliance date at the same time the FDIC expects to amend those provisions through its pending rulemaking.

As a reminder, this delay does not apply to other changes that have already taken effect.

We have updated the “FDIC Policy & Procedures” and “FDIC Signage & Advertisement of Membership Checklist” in the FREE Deposit Tools on our website to reflect this change.
